Is creditor allowed to talk to debtor any way they like?
I have a dispute with this credit card processing company (First American Payment…/Eliot Management Group) about contract termination charges. I have asked them to wait till we settle the dispute in the court. I am even ready to put the money in escrow. But they are making really harassing calls and are verbally abusing me. The California law does not allow me to record the conversation. I called the Sheriff’s department in Yuba County, CA. I was told that the creditor can call every hour if they like and talk any way they like. Is this true? I feel like my own state has tied my hands while this company is abusing me.
