Is a decedent’s spouse responsible for a home equity loan on a house left to wife and kids?
My father recently passed away and left his house to his second wife (who was not on the mortgage), myself and my sister to be divided three ways. There is a home equity loan out on the house, that he had taken out about a year before he passed- and prior to his second marriage. All three of us agree to sell the house immediately. My question is this- is his spouse responsible for the home equity loan he took out (as a spouse in NJ is responsible for their husband/wife’s debts as far as I know) or does that responsibility fall to all three of us to repay?
His house IS the estate.
